These Terms & Conditions (“Terms”) govern your use of Cwtch, including our website, mobile application and related services (together, the “Service”).
Please read these Terms carefully before using Cwtch.
1. About Cwtch
Cwtch is operated by CWTCH Innovations Ltd, a company incorporated in England and Wales under company number 17488925, with its registered office at Forest Lodge, Forest Road, Pyrford, Surrey, GU22 8NA (“Cwtch”, “we”, “us” or “our”).
Cwtch provides technology designed to help couples reflect on and invest in their relationship through personalised experiences, activities and conversations informed by relationship science.
Cwtch is intended to provide relationship support and education. Cwtch is not therapy, counselling, medical care, mental-health treatment or a substitute for professional advice.
2. Accepting these Terms
By creating an account, accessing or using Cwtch, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, you should not use Cwtch.
If you are using Cwtch on behalf of another person or organisation, you confirm that you have authority to agree to these Terms on their behalf.
3. Eligibility
You must meet the minimum age requirement displayed when you sign up for Cwtch.
You are responsible for ensuring that the information you provide when creating your account is accurate and kept up to date.
You must not create an account using another person's identity or allow another person to access your account without permission.
4. Your Cwtch account
You are responsible for keeping your account credentials secure and for all activity carried out through your account.
You should contact us promptly if you believe that your account has been accessed without your permission.
Where Cwtch allows you to invite a partner to join your relationship, each person should use their own account.
5. Using Cwtch as a couple
Cwtch may allow you and your partner to participate in shared activities and experiences.
All information provided to Cwtch will be private to you, no information will be shared with your partner.
You must not attempt to access, obtain or disclose information belonging to your partner that Cwtch has designated as private.
6. Relationship support and important limitations
Cwtch is designed to support reflection, communication and positive relationship habits.
It does not:
- diagnose mental-health conditions;
- diagnose relationship conditions;
- provide medical or psychiatric advice;
- replace a qualified therapist, counsellor, doctor or other professional;
- determine whether you should remain in or leave a relationship;
- guarantee any particular relationship outcome; or
- provide emergency or crisis services.
If you are experiencing serious distress, are concerned about your safety, or believe that you or someone else may be at risk of harm, you should seek appropriate professional or emergency support rather than relying on Cwtch.
Where appropriate, Cwtch may encourage you to seek professional support.
7. AI-generated content
Cwtch uses artificial intelligence and related technologies to provide personalised experiences and responses.
AI-generated content may sometimes be incomplete, inaccurate, inappropriate or unsuitable for your particular circumstances.
You should use your own judgement when considering information provided by Cwtch.
You should not treat an AI-generated response as a professional diagnosis, clinical assessment or definitive judgement about you, your partner or your relationship.
We continually work to improve the quality, reliability and safety of Cwtch, but we cannot guarantee that every AI-generated response will be accurate or appropriate.
8. Your content
You retain ownership of information, messages, responses and other content that you submit to Cwtch (“Your Content”), subject to the rights you grant us under these Terms and our Privacy Policy.
You grant Cwtch the rights reasonably necessary to host, store, process and display Your Content in order to provide and operate the Service.
Where you provide consent for us to use information for product improvement, research or other purposes, we will use it in accordance with the relevant consent and our Privacy Policy.
We will not publicly publish identifiable private relationship conversations without your permission.
9. Our intellectual property
Cwtch and its licensors own all rights in the Service, including its software, design, branding, relationship frameworks, content, text, graphics, interfaces and underlying technology, except for Your Content and third-party materials.
You may use Cwtch for your personal, non-commercial use in accordance with these Terms.
You must not copy, reproduce, modify, distribute, reverse engineer, commercially exploit or create derivative works from Cwtch except where permitted by law or with our written permission.
10. Acceptable use
You agree not to use Cwtch:
- unlawfully or fraudulently;
- to impersonate another person;
- to attempt to access another user's private information;
- to interfere with the operation or security of Cwtch;
- to introduce malicious software or code;
- to attempt to circumvent security or access controls;
- to use Cwtch to harass, threaten or abuse another person;
- to deliberately manipulate or misuse Cwtch's relationship features; or
- in any way that could reasonably put another person at risk.
We may restrict or suspend access where we reasonably believe that the Service is being misused or that doing so is necessary to protect users, Cwtch or others.
10A. Suspension for safety or impaired use
We may temporarily suspend or restrict your access to Cwtch where we reasonably believe that:
- you are using Cwtch while significantly affected by alcohol, drugs or another substance in a way that may impair your ability to use the Service safely or appropriately;
- you are unable to use Cwtch responsibly or engage with its features appropriately;
- your use of Cwtch presents a material risk to you, your partner, another person, or the security or integrity of the Service;
- you are using Cwtch in a way that may create a significant risk of harm, including through threatening, abusive, coercive or otherwise unsafe behaviour; or
- suspension is reasonably necessary to protect you, another user, Cwtch or others.
Where reasonably practicable, we will explain the reason for a suspension and the steps required for access to be restored.
A suspension under this section may be temporary and does not necessarily mean that you have breached these Terms. We may apply a suspension as a precautionary safety measure where we reasonably consider it necessary.
We will exercise this right proportionately and will not suspend access solely on the basis of a protected characteristic or other unlawful discriminatory ground.
Nothing in this section limits any rights you may have under applicable consumer law.
11. Paid subscriptions
Where Cwtch offers paid subscriptions, the applicable price, billing frequency and features will be displayed before you purchase.
Unless otherwise stated, subscriptions renew automatically at the end of each billing period until cancelled.
You may cancel your subscription using the cancellation method provided by Cwtch.
Cancellation will normally take effect at the end of the current paid period unless applicable law requires otherwise.
Any statutory rights you have as a consumer are unaffected by these Terms.
12. Trials and promotional offers
From time to time, Cwtch may offer free trials, promotional pricing, rewards or other offers.
Additional terms may apply to a particular offer. Where they do, those terms will be provided before you participate.
We may limit, withdraw or change promotional offers where permitted by law.
13. Payments
Payments may be processed by a third-party payment provider.
We do not generally store your full payment-card details on our own systems where our payment provider processes those details on our behalf.
You authorise the applicable payment provider to process charges associated with your subscription.
14. Availability and changes to Cwtch
We will use reasonable efforts to keep Cwtch available and functioning, but we cannot guarantee that it will always be uninterrupted or error-free.
Cwtch may occasionally be unavailable because of maintenance, updates, technical failures, security incidents or circumstances outside our reasonable control.
We may change or improve features of Cwtch from time to time.
Where a change materially affects your rights or the service you have paid for, we will provide any notice required by law.
15. Third-party services
Cwtch may integrate with or rely upon third-party services, including hosting, analytics, payment, communications and AI technology providers.
Those services may be subject to their own terms and privacy policies.
We remain responsible for our obligations to you under these Terms, but we cannot guarantee the availability or performance of third-party services outside our reasonable control.
16. Suspension and termination
You may stop using Cwtch at any time.
You may delete your account using the available account controls or by contacting us.
We may suspend or terminate an account where reasonably necessary to:
- comply with the law;
- protect users or others;
- address serious security or safety concerns;
- prevent fraud or misuse; or
- enforce these Terms.
Where appropriate, we will provide notice before termination.
17. Data protection
We process personal data in accordance with our Privacy Policy.
Our Privacy Policy explains what information we collect, why we use it, the circumstances in which we may share it, how long we retain it and your rights.
18. Liability
Nothing in these Terms limits or excludes liability where doing so would be unlawful.
Subject to that, Cwtch will not be responsible for losses that were not reasonably foreseeable when you entered into these Terms or for matters outside our reasonable control.
Nothing in these Terms limits your statutory consumer rights.
Any additional limitations of liability will be drafted in accordance with applicable consumer law.

20. Changes to these Terms
We may update these Terms from time to time.
Where changes are material, we will provide appropriate notice.
The latest version will always be made available through Cwtch.
21. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also have rights to bring proceedings in another part of the UK where applicable.
